This is an English convenience translation of the Dutch Privacyverklaring of Simar. In the event of any discrepancy, the Dutch version prevails.

1. Who are we?

Simar automatisering B.V. and Simar Belgium B.V. ("Simar") develop and operate software for the interior design industry. In this Privacy Statement, Simar provides information about what Simar does with your personal data in this context ("Privacy Statement").

2. How do we obtain your personal data?

Simar registers personal data that you provide to Simar yourself and/or that is obtained when you use the services of Simar.

When you fill in a form on our website, for example to request a demo or to contact us, Simar asks you to provide your personal data. Simar uses this data to contact you about your request. When you sign up for the Simar newsletter, Simar uses your data to send you the newsletter. We store this data in our customer relationship management system (Zoho CRM). There it may be combined with data from earlier contact between you and Simar, so that we can follow up on your request in the right context.

Simar obtains some personal data automatically, for example through the use of cookies and similar techniques. When your computer or mobile device contacts the web servers of Simar (for example when you visit the website), the web servers of Simar automatically collect usage information. More information about this is included in our cookie policy.

3. What personal data do we process?

The personal data that we process are:

  • first and last name;
  • company name;
  • address details;
  • telephone number;
  • email address;
  • the content of your message or request;
  • data collected automatically when you visit our website: your IP address, information about your browser and device (such as type, operating system and screen resolution), the pages you visit and the time of your visit;
  • your cookie choice (see our cookie policy).

4. For what purposes do we process your personal data?

There are various purposes for which we may process your personal data. Simar uses your personal data to:

  • answer and follow up on your request via a form on our website;
  • perform the agreement with you;
  • send you the Simar newsletter;
  • call or email you if this is necessary to carry out our services.

5. On what legal grounds do we process your personal data?

Simar processes personal data on the basis of the following legal grounds:

  • Performance of the agreement with you. Simar processes personal data in the first place in the context of the performance of the agreement with you;
  • Legal obligation. Simar processes your data to comply with an applicable legal obligation, for example to comply with applicable minimum retention periods or tax obligations;
  • Legitimate interest. Insofar as the processing is not necessary in the context of the (precontractual phase of the) agreement or compliance with an applicable legal obligation, Simar may process your personal data on the basis of its legitimate interests. This is only the case if these interests outweigh your privacy interests. The legitimate interests of Simar in that case correspond to the purposes stated above;
  • Consent. If Simar cannot rely on one of the grounds mentioned above, Simar will ask your consent for processing personal data.

6. How long do we keep your personal data?

Simar does not keep your personal data longer than necessary for the purposes for which it was collected. We apply the following retention periods:

  • requests via the forms on our website (demo and contact requests): 12 months after the last contact, unless a customer relationship arises;
  • prospect data in our customer relationship management system: 24 months after the last contact;
  • customer and contract data: for the duration of the agreement and 7 years thereafter under the statutory tax retention obligation;
  • newsletter data: until you unsubscribe;
  • technical log files of our web server (including IP addresses): a maximum of 30 days;
  • Google Analytics data: 14 months, only after your consent;
  • your cookie choice: 12 months, after which we ask for your choice again.

7. With whom can we share your personal data?

Simar only provides personal data to third parties in the following cases:

  • For the performance of our agreement with you. For example, we share your personal data with SHD Solutions GmbH for KPS.MAX;
  • To comply with a legal obligation;
  • In some cases the information may be shared internally. Our employees are obliged to respect the confidentiality of your data.

In addition, Simar uses service providers (processors) that process personal data on behalf of Simar:

  • Zoho Corporation B.V. for the forms on our website and our customer relationship management (CRM). The data is stored in data centers within the European Union;
  • Google Ireland Limited for Google Analytics, only when you have given consent for this via the cookie banner (see our cookie policy).

8. Cookies and related technologies

When you use our website, we register your settings and preferences regarding your use of our website by means of cookies and similar technologies. We use these cookies for the proper functioning of the website and, after your consent, for analytical purposes. See our cookie policy for more information.

9. How do we secure your personal data?

Simar takes technical and organizational measures to secure the personal data that it processes.

An example of a technical measure that Simar applies is that only authorized employees of Simar may view your data. In addition, we use encryption of your data where possible. Our website is only accessible via a secure connection (https).

10. Is your personal data provided to countries outside the European Union?

Your personal data is in principle processed and stored within the European Economic Area ("EEA"). The hosting servers used by Simar are also located within the EEA. Only when you give consent for Google Analytics can data about your website visit be transferred by Google to the United States. Google LLC is certified under the EU-US Data Privacy Framework, which ensures an appropriate level of protection.

11. What privacy rights do you have?

If we process your personal data, you have a number of privacy rights. The extent to which you can exercise these rights depends on the circumstances of the processing, such as the manner in which we process the personal data and the legal ground for it. In short, you have the following rights:

  • Right of access. You can ask which personal data we use about you. This allows you to check whether we do so correctly under the privacy law, the GDPR.
  • Right to rectification. You have the right to rectification of personal data when it is incorrect, incomplete or not relevant.
  • Right to erasure. In some cases you can ask us to delete your personal data.
  • Right to restriction of processing. You can ask us to temporarily stop using your personal data.
  • Right to data portability. You can ask us to transfer your personal data to another organization.
  • Right to object. You can sometimes object to the processing of your personal data.
  • Right to human review of decisions. You have the right, under certain circumstances, not to be subjected to a decision based solely on automated processing, without human intervention.
  • Right to complain. You have the right to file a complaint with the supervisory authority for the GDPR: in the Netherlands the Dutch Data Protection Authority (Autoriteit Persoonsgegevens, AP), in Belgium the Belgian Data Protection Authority (Gegevensbeschermingsautoriteit, GBA).

Below we have explained a number of rights in more detail. More information about your privacy rights can be found on the websites of the Dutch Data Protection Authority and the Belgian Data Protection Authority.

How can you indicate that you no longer wish to receive commercial communications?

You always have the right to object to the use of personal data for commercial communications. When you indicate that you no longer wish to be approached (via a certain medium), Simar will include you, with the required data, in a file kept for that purpose, and your personal data will no longer be used for these purposes.

Can you withdraw consent once given?

Consent once given can be withdrawn by you at any time. Withdrawing consent is only possible when you have actually given this consent.

Exercising your rights and handling of your request

If you wish to exercise one of the rights mentioned above, you can send an email with the relevant request to info@simar.nl (for Belgium: info@simar-belgium.be). We do not ask for a copy of your identity document as a standard requirement. Only if we have reasonable doubt about your identity may we ask you for additional information to confirm that the request comes from you.

Simar will inform you within one month of receipt of your request whether we can comply with your request. This period can be extended by two months in specific cases, for example when the request is complex. We will inform you of such an extension within one month of receipt of your request. Under privacy legislation we may, under certain circumstances, refuse your request. If this is the case, we will explain why. When you object to the processing of your personal data for direct marketing purposes, we will always respect this request.

How can you file a complaint?

If you have questions or complaints, you can contact us using the details below. Although we appreciate it if you give us the chance to resolve your complaint, you also always have the right to file a complaint directly with a competent supervisory authority when you believe there is a privacy breach. We do everything we can to resolve this together with you. In most cases this fortunately succeeds. Are you still not satisfied with how your complaint has been resolved? Then you can send your complaint to the Dutch supervisory authority, the Dutch Data Protection Authority (Autoriteit Persoonsgegevens, P.O. Box 93374, 2509 AJ The Hague), or to the Belgian supervisory authority, the Belgian Data Protection Authority (Gegevensbeschermingsautoriteit, Drukpersstraat 35, 1000 Brussels).
